A witness reported seeing two male drivers in front of him exit their cars before the altercation. The first male in line was Tom Snyder who got out of his vehicle, a black Chevrolet. He exited and approached the second vehicle in line, a red Subaru, which John Robert Marino previously had exited from with a handgun he retrieved from his holster on his belt.
Snyder approached Marino far enough when Marino drew his firearm and aimed it directly at Snyder’s forehead. He held the gun to Snyder’s head screaming at him.
After the altercation Snyder returned to his car and left the scene, followed by Marino. They both pulled onto Interstate 80 but drove in different directions.

Snyder stated that he had been following the red vehicle around the parking lot of Walmart before leaving. He reported that the other vehicle was driving very slowly so he decided to go around said vehicle and pulled onto Walmart Drive.
After stopping at the stop sign, he noticed the other male, Marino, in the vehicle behind him exit his car, noting that it was the same one he had passed just before pulling onto this street.
Snyder then exited his vehicle and approached Marino, both males were yelling and cursing at each other as Snyder got closer to Marino.
As he approached the other male subject, Snyder reported that he pulled a gun in his face and yelled something to the effect of, “get back in your vehicle or I’m going to blow your f**king head off.”
Snyder then reported that he went immediately back to his vehicle and drove away to call 911.
